First, for anyone who says Credit Repair is illegal, the government passed the "Credit Repair Organizations Act" in 1996. Why do you charge a monthly fee verses charging by the work load?

The next month you only had one deleted item and owed $35. When are payments debited or transferred?
You have complete control and decide when your payment will be taken. Your FICO score optimization & credit analysis work is completed before this fee is charged to the payment method you chose.

Your monthly payments will then be drafted each month after work has been completed. The original date you selected will be the date used to schedule your monthly serviceability plan. We will schedule and complete all work on your behalf prior to that date. You do have the ability to change your scheduled payment date by calling (800) 111-1111 our office with a 5 business day notice and request a change to that date. This request requires a $5.00 fee

Can I cancel your credit repair service at any time?
Yes, we offer a no risk-hassle free cancellation policy that allows you to cancel for any reason with a 5 business day notice. You can cancel your serviceability plan at any time by calling (800) 111-1111.

What happens if don’t have the money for my payment?

Our policy when a payment is returned unpaid is to attempt to collect the payment throughout the time period before your next letter work and action is completed. We charge a $15.00 late fee for each late payment.
When your next round of dispute letters are due and there is still no payment received, your account will be put into a hold status until your payments are caught up and we will then resume working on your behalf. There is an additional $10.00 charged as a reactivation fee when an account is placed on hold.

Can negative items be removed?
This depends on the circumstances with each item. Our Credit Analysis service will help you identify whether a negative item is inaccurate, unverifiable, misleading, untimely, unclear, ambiguous, or incomplete and can be legally disputed and/or removed. There are additional client rights that allow you to contact your creditors directly and validate the negative item information which can result in having it removed from your reports.

What is accurate?
Accurate is 100% free from error, and is in no way unclear, ambiguous, untimely, incomplete, or misleading.

What is verifiable?
Verifiable simply means that credit information can be verified with the creditor. If a creditor is unwilling, unable, or unavailable to verify that a credit item is accurate and timely, it must be removed.
Who decides is the item on your credit report is questionable?
You do. There are several fields of information reported on your report, name, balance, high credit, date of last transaction, account number, etc. All of this information is required to be reporting accurately. Can accurate items really be removed?
If you believe that a negative credit item is 100% accurate and timely, you do not have the grounds to question this item with bureaus. At this point the bureaus will utilize the “Up-To 7-10 years” time period before they will remove the negative item.

However, just because an item cannot be questioned with credit bureaus does not mean it cannot be removed from your credit reports.

Can negative credit items be legally removed?
You have the legal right to have an accurate, timely and verifiable credit report. If information recorded on your credit reports does not accurately represent you fairly and accurately, then you have the right to request that questionable information be removed from your reports. The Fair Credit Reporting Act (FCRA), Fair Credit Billing Act (FCBA) and the fair Debt Collections Practices Act (FDCPA) afford you the legal right to dispute inaccurate items on your credit reports with the credit bureaus as well as your creditors.

When you dispute a questionable negative credit item with the credit bureaus, you are demanding that they perform an investigation to determine whether or not the item should be listed on your credit reports. If the credit bureau cannot verify the accuracy of the item, then they are required to correct the listing or completely delete it from your credit report.

You also have the option of working with your creditors to remove the negative items from your credit reports. Your creditors have the ability to delete negative items from your credit reports whenever they chose. This process can sometimes produce better results than dealing with the credit bureaus.

How long does credit repair take?

Does paying my old debt off restore my credit?
Common sense would lead you to believe that the answer is yes. However, in this circumstance , that is not correct.

When you pay an old debt, the negative credit listing doesn't disappear. Typically the only thing that changes is the balance owed field and this has absolutely nothing to do with your score. In fact, it is not uncommon for the bureaus to “update your date of last activity” and if the old debt is updated by the date, this will actually lower your credit score. What is a credit report?
Your credit reports are a record of your credit history that is maintained by the credit reporting agencies.

Whenever you apply for credit or financing, a credit report is usually pulled from at least one of the three    major credit bureaus. There are many credit bureaus in America; however, the “Big Three” most common credit bureaus are Experian, Trans Union or Equifax.

All US credit bureaus collect and maintain information on Americans. Most people are surprised to learn that the credit bureaus are not affiliated with the government in any way. The credit bureaus are for-profit companies whose principal work product is the compilation of information known as a "credit report." The credit bureaus generate their profits by selling the personal information in your credit reports to credit grantors, potential employers and even back to you.

The credit bureaus receive your personal information through the same lenders who grant you credit.          They have agreements with each of these credit grantors that require the credit grantor to inform the credit bureaus of everything that occurs in your relationship with the credit grantor. If you make a payment late, the negative credit listing is quickly reported to at least one of the three major credit bureaus and is added to your credit history.

The credit bureaus collect this information, list it on your credit report, and then sell it to other credit grantors who wish to see your credit history before they decide to lend you money. The credit grantors who review  your credit are especially interested in any negative credit. If you have shown any tendency to pay late, or to disregard your financial commitments in the past, the creditors will likely reject your application or charge a higher interest rate.

It is important to note that your credit reports are not just a record of how you are currently managing your credit accounts. Credit reports are histories of everything you are doing with your credit now and what you have done in the past seven to ten years.



What kind of information appears on a credit report?
Aside from your personal information such as your name, address and employer, your credit reports contain four categories of listings that are used to generate your credit score.

Merchant Trade Lines
These include all regular credit lines such as department store cards, auto loans, mortgages, and credit cards.   If there is any history of late payments, or if the trade line was included in bankruptcy, charge offs, or put into repossession, the listing will be considered negative by all credit grantors.

Collection Accounts
When an account is referred to collections because of delinquency or because of a bad check, this appears on the credit report as a collection accounts. Collection accounts can appear as paid or unpaid accounts. Any type of collection account, whether paid or not, is considered very negative by all credit grantors.

Court Records
Court records include bankruptcies, judgments, liens, divorce, satisfied judgments, and satisfied liens. All court records, including satisfactions, are considered negative by all credit grantors.

Inquiries
Every time a potential credit grantor looks at your credit file, a credit inquiry appears on at least one of your credit bureau reports. If the numbers of inquiries are few over the last two years, then there may be no negative effect on your credit worthiness. However, if there are many recent inquiries showing on your credit report, credit grantors may become nervous and deny you credit.

How long do negative items stay on a credit report?
The Fair Credit Reporting Act requires that most negative credit items remain on your credit bureau file for up to seven years, except for bankruptcy, which can be reported for up to ten years and in rare cases even longer. Inquiries may remain on a credit report for up to two years.

Are items such as bankruptcies and foreclosures impossible to remove or correct?

There is not one type of questionable listing that cannot be removed from a credit report if it is inaccurate, untimely, misleading, biased, or incomplete. While negative items such as bankruptcies or unpaid debts are more difficult to remove from your credit reports, this has more to do with the identified importance of the credit line item. For example, bankruptcies, foreclosures, judgments and tax liens.
Can a bankruptcy wipe the slate clean?

A bankruptcy may help you take control of your debts and get a second chance on better managing your finances. This does not help clean up your credit reports..

Many bankruptcy attorneys apparently do not adequately understand or explain the effects of bankruptcy to their clients. Most Attorneys are more concerned about their “Income”. Simply Stated, bankruptcy is to the credit rating that the nuclear bomb is to war. It may end the war, but it leaves a huge mess.
When you file for bankruptcy, every credit account that you decide to include in bankruptcy will become an "included in bankruptcy" account (a seriously negative item).

Additionally, a bankruptcy filing and bankruptcy discharge listing will appear in the court records section of your credit report. Because so many negative items are attached to the bankruptcy, it becomes very difficult to remove all trace of the bad credit.

Does the 100 word statement on the credit report help?

The Fair Credit Reporting Act gives consumers the right to add a brief statement to their credit reports explaining disputed items. Our experience has shown that these statements are useless, confusing and more importantly, damaging to the credit reporting scoring system.

Many misinformed credit experts suggest using this statement to explain your side of the story when a negative item on your credit reports is lowering your credit score. Unfortunately, because human eyes rarely read through the details of your credit reports, this explanation most likely will have zero effect on a creditor's opinion of your creditworthiness.

Even worse, when you add a statement on your credit reports such as "these payments were only late because there was a problem with the company's automatic withdrawal system", it can be interpreted as an admission of guilt. If you try to dispute the item in the future, the credit bureau will not need to bother contacting the credit grantor to determine the accuracy of the negative item because your credit statement already admits you were late in making the payment.

Because of their ability to hinder your credit repair efforts, we suggest making a 100 word statement should be the first things you delete from your credit file.

Do negative items have to remain listed for 7 years?

Most Americans think that most negative credit items remain on your credit report for 7 or more years.
The FACT is that there is absolutely no laws, what-so-ever, that demand any minimum required time periods for negative listed items to be reported on your credit reports. When you speak with certain creditors, their typically under-educated staff may tell you that the law demands that negative listings appear on your credit report for seven to ten years. Another example of the “Propaganda Information”
we are forced to accept.

The truth is that the credit grantor or the credit bureau can choose to delete the negative credit listing at any time, especially when you have given them a reason to do so. The 7-10 year term is merely a time limit for reporting negative credit. Some items, like bankruptcies, may remain on a report for longer periods of time, such as 10 years.

What is the Fair Credit Reporting Act (FCRA)?

Public Law 91-508

The Fair Credit Reporting Act (FCRA) allows a consumer to challenge the information on theirs credit report on the basis of "completeness and accuracy." If, after a reinvestigation by the credit bureau, the disputed information "is found to be inaccurate or can no longer be verified, the credit bureaus(s) shall promptly delete such information."

The credit bureaus are required to complete the investigation within a "reasonable period of time." This period has been set at thirty days.

The credit bureaus can ignore the consumer dispute if they have reason to believe that the dispute is "frivolous or irrelevant." The FTC commentary on the FCRA cites, as an example of a frivolous dispute, a dispute wherein the consumer challenges all negative items on his credit report without providing any allegations regarding specific items in the credit file. However, "A credit bureau must assume a consumer's dispute is accurate and correct, unless there is clear and convincing evidence to the contrary."

When a consumer challenges a credit listing on the basis of extenuating circumstances, such as health problems, divorce, job loss, etc., the credit bureaus may decide to ignore that dispute as frivolous.

When a consumer submits a dispute, which is neither frivolous nor irrelevant by credit bureau standards, the credit bureau must validate the accuracy of the information which requires verification from the original sources or other reliable sources of the disputed information and inform them of the nature of the consumer's dispute.
Your credit report is requires it to be an accurate, timely and verifiable.
This is a roadmap that creditors use to determine your credit risk.

Because errors in the credit reporting system can impact the accuracy of your credit reports, you have the right to repair these inaccurate, outdated, questionable negative credit items.

How can I tell if a company is legitimate?
The FTC Warns against Credit Repair Scams and offers advice on how to avoid them.
The Federal Trade Commission (FTC) is responsible for enforcing consumer protection laws in the United States. The FTC offers ongoing suggestions and warnings to consumers regarding credit repair companies. Some of the top listed warnings are listed below.
1. Beware of credit repair companies that request to be paid in full in advance.
2. Beware of credit repair companies that suggest you obtain "new" identities.
3. Beware of credit repair companies that don't disclose your legal rights.

Can Credit Repair Companies charge up-front?
